Snorkeler Run Over by Motor Boat

Description:
On May 11, 2007, Plaintiff was snorkeling off the beach at the XYZ Resort in Freeport, Grand Bahama Island, Bahamas when he was run over by a motor boat being operated by the resort's local Bahamian water sports activity concessionaire, who provided to resort guests and the public sailing, jet skiing, parasailing, banana boat rides and snorkeling tours off the property.

The resort and local Bahamian water sports activity concessionaire had set orange buoys offshore in an attempt to create a safe swimming area but the system was inadequate because the buoys were mooring buoys, were several hundred feet from each other and were not roped together in any fashion.

Further, there were no signs on the beach informing or warning that swimming was not permitted beyond the buoys.
